just wonder, what about *servers written from scratch*? (not that this is very likely, but still wonder lol)

As long it doesn't contains any opentibia scoure code or based on it that is licensed under the GNU GPL. People can do anything they can if they made it 100% by themselfs, so they can release something without a scoure.
