Payments for virtual goods/services legal on OT?

I've always understood that any flow of cash into an OT needed to be called a donation for legal reasons. Now I'm being told if you're not using any copyrighted material, (which I'm not, I'm using 8.5 which means you can use YATC to connect, therefore no copyright material being used) you can call your donation area a 'point shop' and call it payments to the point shop, and consider it legal. Is this true?

The YATC client is still using some graphics from CipSoft, so It isen't legal.
Everyone who is buying points from your 'website/server' is only doing it because of all items they will recieve, not for helping your server.
So they're buying stuff from you, so they're not donating to you.

it is not your responsibility that your players use the tibia client to connect to your server, however it is also not a donation it's a sale of a service.
