It has all to do with this theard. When people start to assume how CipSoft operates.

You don't need to assume anything. It's just how it works for any business or individual. In a way, it can be seen as common knowledge.

I know what is legal or not. But i don't want people to think, that CipSoft will never sue or etc...

I'm pretty sure that any serious hoster, is already familiar what is legal and not.

I quote what @Mark said:

https://en.wikipedia.org/wiki/Berne_Convention Despite how it's enforced locally, the general lines are set internationally. It's safe to say that you can be sued by using copyrighted stuff nearby anywhere on Earth. That it's not viable, nor how CipSoft used to deal with it is another thing.

So, in essence, you may alter any of Tibia's sprites (even a single pixel), and as long as you give credit to them, you are technically safe under the Fair Use Act, as you could argue it is promoting innovation and encouraging growth.

That's not how it works anywhere, you can't do shady stuff and argue that you aren't doing it so a case against you won't hold.

That is how it works. Maybe you don't understand what I said? Read the entire post, not a single sentence. :p

Either way, it doesn't matter. CipSoft is not going to take legal action against anyone in Open Tibia. It has never happened and will never happen because it is not worth it for them to do so, both financially and publicly (for their image). Do you really think a company will go after kids hosting little projects? No, that's not going to happen.

It can become a serious problem elsewhere, but not here.

If you do marginal changes to copyright work to make use of it and after sued claim it's in name of promoting innovation and encouraging growth it won't hold.

But in our case you are totally right, it won't happen ever, as it does not worth.

I did a fast research and found nothing. But you are right, there was a story about CipSoft legaling threating a server, that shutdown sooner after, but we never saw a official note from CipSoft nor it happening again or lately. It also could have been just an excuse or false rumors.

Guido Lubke actually did file a lawsuit against RealOTS, he would send the paper work to Dennis to sign but it never got to that.

Remere officially said Classictibia closed due to a lawsuit from CIP. The thing is you can sue someone for anything. If you are into OT to make money, you better make sure you are on the right side of the law.

Yeah, I can sue you for spreading lies. :(

I played the server while it closed. The first time the URL explained the threats from CIP. People speculated it was bullshit and that Remere was just tired of the server.
