Your Own Game - Tibia's System/Gameplay, Legal?

Depends if Tibia decides to take legal action, so far no law has been broken since Tibia has not restricted the rights to the client and the only thing I know that tibia would get mad at is the RL Map but so far nothing. The gameplay on the other hand there is no restriction to that or so many other games would be sued
 
Yes, so far no law has been broken with the client cause of the unrestricted rights about the client. And yes, I think you're right concerning the gameplay. Otherwise many RPG-games would be sued.

Some1 hcked tibia server and took the server and sold it for(800$) as i remember
 
I read somewhere long ago that hosting an OTServ is not illegal, but logging onto one using an IP Changer is illegal.

I think it's because your using THEIR client, whereas OTServ sources are made for public use, which are just "mimicking" CipSofts sources.

If you understand what I mean.
 
Should be legal. afaik they don't have a copyright on their game-style. If you recreate all that even with using open tibia source you're 100% good.

The only issue is editing their client and SELLING THE CLIENT. Donations don't count. You don't sell the client as your own. The sprites afaik aren't copyrighted since i think cipsoft used another games aswell as the perspective. Cipsoft wouldn't even pursue a server that they wouldn't profit from. For example (court fees = £300) your fine (all money you made plus compensation) so if you made less than £300 profit, you wouldn't be pursued.

Note: £300 is a rough figure, not exact - depending on the situation costs may cost considerably more so don't worry. All that would happen if cipsoft found you to be part of an open tibia server is a ban on real.. IF that.

Forget legal issues, it isn't worth persuing for such a small gain/large loss.

Rule of thumb is never to sue anyone who has no money.
