We can use our own sprites with Tibia's client already. But ye i see ur pointYes, I am aware of this. I was implying that by adopting OTClient as our official client, it will allow us to use custom sprites, etc. as opposed to relying on Tibia's client and being forced to use their sprites. Seems fairly obvious to me.
Agreed, it is very odd that servers such as telania, morgana, gunzodus, all those 1000+ player identical real tibia servers are not dealing with this.Hmm this looks so strange. Why other (bigger) servers are not affected than. Probably youve got a lot of chargebaks ?
Do you own servers that restart constantly? I know someone who did that (launched a new server every month) and his got closed cause of tons of chargebacks (no surprise when constantly restarting new servers
We manually added points for the first 1-2 months of Archlight. It is a possible solution
This can be avoided with a EULA saying:If you ban someone who bought premium content YOU HAVE TO GIVE HIM BACK ALL PREMIUM points/things or give him back his money.
This is in Paypal's terms of use which you accepted after making an PP account. Also this thing is in every European country's law and in almost all states of USA.
A servers Terms of Service dont override PaypalsThis can be avoided with a EULA saying:
- "Accepting this means that you're donating to support our server. We can't refund or take responsibility if anything happens with your points/character."
Yes, but using it means that you will have no problems with Paypal like him.A servers Terms of Service dont override Paypals
I don't see how Open Tibia servers violate PayPal's Acceptable Use Policy. It's the same reason that running Open Tibia servers is not illegal.
Open Tibia server owners are running open source software. It's the end-user that's utilizing / modifying CipSoft's intellectual property (Tibia Client, Tibia Sprites.) The software runs independently of this, and it's the responsibility of the end-user to not infringe on these rules / laws.
It's probably a violation of CipSoft's intellectual property to host an edited version of their client on your website, as well as their sprites (items, character outfits.) For these reasons, CipSoft and PayPal probably do have a case.
Furthermore, CipSoft would not bother fighting these cases with server owners because modifying / hosting their intellectual property on a website is not costing them loss of revenue; the legal open source software is costing them loss of revenue. I won't even get into how CipSoft cannot afford to even contact Open Tibia server owners over something that wouldn't provide them any extra revenue.
@Samaster my suggestion would be to call PayPal's customer support and explain that you are not hosting / using / modifying CipSoft's intellectual property in any way; you do not need their permission. You have permission to run the software you are running on your server.
You need to call PayPal - this is important. They will screw you up the wall via E-mail / Support Ticket. It's funny how much different customer support is when they have to speak to someone over the phone.
Best of luck!

Ok thank you so much for such an in-depth response, and for responding as quickly as you did. My server is my business, and I cannot under any circumstance have my income withheld in any way. I will ring Paypal first thing tomorrow morning and explain to them what I am doing is not illegal. However I have tried to explain that, but they keep going back to the permission from Cipsoft. I think I'm pretty confident on the phone so I'll do my best.

It's my pleasure! Let us know how it goes, and don't give up after the first person you talk to. Not everybody can accurately understand the intricacies of your Open Tibia operation, don't be afraid to ask for another representative / a manager. If they refuse, you can always call back until you get another representative.
I surely hope you're young or you have better prospects coming in the future. I would never recommend an Open Tibia server as a sole source of income for a long period of time.

Is there some reason to give payments manually ?Do you own servers that restart constantly? I know someone who did that (launched a new server every month) and his got closed cause of tons of chargebacks (no surprise when constantly restarting new servers

Using OTClient or not wouldnt make a difference. It's still their game, with the sprites or dat file they can still prove that they made it.
Since you are global mod, maybe ask Mark about a resprite project? Official, runned by otland. Because any actions without a "kickstart" from ot community leaders would be a failure.I don't see how Open Tibia servers violate PayPal's Acceptable Use Policy.
